The opinion of the court was delivered by This is an action to recover damages for personal injuries sustained in a collision between an automobile and a utility pole after the driver lost control of his car as the result of striking two chuckholes in a township road. The plaintiff, James Thomas, a minor, brought this action through his father and natural guardian, Eldon L. Thomas, against the Board of Township Trustees of Salem Township and the Board of County Commissioners of Sedgwick County for defects in the maintenance of the road and against the Kansas Gas and Electric Company for negligent placement of the utility pole. The case proceeded to trial and, at the close of the plaintiff's evidence, the trial court granted motions for a directed verdict in favor of Sedgwick county and Kansas Gas and Electric Company. The case was then submitted to the jury on the basis of the comparative fault of plaintiff and Salem Township. [224 Kan. 540]
